Consumer Health Privacy Notice
This Consumer Health Privacy Notice (“Notice”) is intended to supplement the Ascendis Pharma U.S. Privacy Statement to provide additional notices related to Consumer Health Data as defined by Washington and Nevada law. Washington and Nevada require Ascendis Pharma and its wholly owned subsidiaries ("Ascendis Pharma" or "we") to provide you with additional information about how we may collect, use, disclose or otherwise process your Consumer Health Data, how we protect it, and your rights and choices with respect to your Consumer Health Data.
This Notice applies to all Ascendis Pharma operations as well as websites, mobile applications and digital services ("Services") that link to or post it.
Scope
“Consumer Health Data” for purposes of this Notice has the definition given in Washington or Nevada law, including information that identifies or is reasonably capable of being associated or linked, directly or indirectly, with a particular consumer and that identifies the consumer’s past, present, or future physical or mental health status. This Notice applies only to residents of Washington and Nevada and individuals whose information is processed in Washington or Nevada.
This Notice does not apply to the personal information that we collect and process about Ascendis Pharma workforce members, including job applicants; active and inactive Ascendis Pharma employees; former employees; retirees; dependents; beneficiaries; employees of Ascendis Pharma’s third-party vendors and partners, such as contractors on assignment at Ascendis Pharma; and other individuals about whom Ascendis Pharma collects personal information for HR-related purposes. In addition, it does not apply to Consumer Health Data that is used to engage in public or peer-reviewed scientific, historical, or statistical research that adheres to all other applicable ethics and privacy laws.
Consumer Health Data Practices
Categories of Consumer Health Data
The categories of Consumer Health Data we collect will depend on how you interact with Ascendis Pharma Services and the information you choose to provide. We may collect:
- Individual health conditions, treatment, diseases, or diagnosis
- Social, psychological, behavioral, and medical interventions
- Health-related surgeries or procedures
- Use or purchase of prescribed medication
- Bodily functions, vital signs, symptoms, or measurements of other types of health information
- Diagnoses or diagnostic testing, treatment, or medication
- Gender-affirming care information
- Reproductive or sexual health information
- Biometric data
- Genetic data
- Precise location information that could reasonably indicate a consumer's attempt to acquire or receive health services or supplies
- Data that identifies a consumer seeking health care services
- Other information that may be used to infer or derive data related to the above or other health information
Purposes for Collection
With your consent, we may use the Consumer Health Data we collect for the following purposes, as further described in our Privacy Statement:
- Providing Services and support. To provide and operate our Services; communicate with you about your use of our products and Services (e.g., through newsletters and emails), where you have requested information regarding participation in a clinical trial with Ascendis or one of our partners, to support disease management, education, or decision support systems related to the use of our products and Services, assisting you in the completion of your application to participate in our patient support program or similar Services, the assessment of your eligibility for any such requested Services, the fulfillment of the Services, as well as any applicable renewal of such Services, including through the use of our AI tools that assist our patient support centers; fulfill product orders or requests for samples; provide troubleshooting and technical support; respond to your inquiries; gather customer feedback; fulfill your requests; process your payments; communicate with you; and for similar Service and support purposes.
- Research and analytics. For purposes of conducting research and analytics to understand, improve, evaluate, and develop our Services, products and business processes, and to develop other insights. We may administer surveys and questionnaires for market research or quality and satisfaction purposes. We also use Consumer Health Data that we collect about your use of our Services to better understand how users access and use these Services and for other research and analytical purposes, such as to evaluate and improve our Services and business operations, to develop new Services and features, and for internal quality control and training purposes. We may also analyze public sources, such as websites and social media channels, for information related to or reported about us and our Services.
- Customization and personalization. To tailor the content that we may send you and that we may display on the Services, including to offer personalized help and instructions, and to otherwise personalize your experience.
- Marketing and advertising. For example, to send you information about our Services, such as newsletters, and other marketing content, including about third-party products and services we think may interest you, as well as any other information that you sign up to receive, as permitted under applicable law. We also may use certain Consumer Health Data that we collect to manage and improve our advertising campaigns so that we can better reach individuals with relevant content.
- Quality, safety and regulatory reporting. We may record and report on the health and other information that we collect associated with product safety or quality, and other adverse incident reports in compliance with our legal regulatory obligations. We may also contact you to seek additional information from individuals who report or communicate such product safety, quality, and other adverse incident information, in order to fulfill our legal and regulatory obligations. The information you provide Ascendis Pharma is very important and will be used in the safety monitoring of our products for reporting and public health purposes.
- Security and protection of rights. To protect our Services and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our Privacy Statement.
- Legal proceedings and obligations. To comply with the law and our legal obligations, to respond to legal process and related legal proceedings.
- General business and operational support. To consider and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions.
Sources of Consumer Health Data
As described further in the Personal Information Collected section of the Privacy Statement, we collect personal data (which may include Consumer Health Data) directly from you, from your interactions with our products and Services, from third parties, and from publicly available sources:
- We may collect additional information such as Consumer Health Data related to your interactions with our products and Services.
- When permitted and through our use of cookies and other automatic data collection technologies, when you visit our websites, use our mobile applications, open or click on emails we send you, or interact with our advertisements. We or third parties we work with may automatically collect certain information using technologies such as cookies, web beacons, clear GIF, pixels, internet tags, web server logs, and other data collection tools. Additional information regarding the specific Cookies that are run on our website can be found in a list of cookies and third party tools found on each of our Digital Properties.
- From healthcare professionals.
- From government agencies and/or public records.
- From service providers, data brokers, or business partners.
- From industry and patient groups and associations.
- From publicly available sources, including information provided on websites, social media channels, public forums or platforms, and other third-party sources.
Ascendis Pharma does not sell your Consumer Health Data to third parties. We may disclose Consumer Health Data to our processors for our business purposes or at your direction to provide you with products and Services that you request.
Disclosure of Consumer Health Data
Generally, and as permitted, we share or disclose the Consumer Health Data with:
- Ascendis Pharma Affiliates.
- Service providers who assist us in the provision of programs and Services.
- Third party business partners with whom we conduct joint business activities.
- Third parties with whom we have marketing arrangements, as permitted by law.
- Third parties that help administer, manage, and analyze our programs and Services.
- Third party platforms, providers and networks.
- Third parties in connection with business transactions.
- Third parties for product quality and safety and adverse incident reporting.
- Third parties to comply with our general legal obligations.
- Third parties for security and protection of rights.
- Third parties that process your Consumer Health Data at your direction.
Your Rights and Choices
You have the following rights with respect to your Consumer Health Data:
- The right to confirm whether we are collecting, selling or sharing your Consumer Health Data
- The right to withdraw consent for us to collect or share your Consumer Health Data
- The right to request that we delete your Consumer Health Data
- The right to correct your health Consumer Health Data
There may be certain exceptions that apply to your request. To exercise your rights, you or your authorized representative may submit a request to DataPrivacy@ascendispharma.com or 1-844-442-7236. You may be entitled, in accordance with applicable law, to appeal a refusal to take action on your request. To do so, please contact us by using one of the methods listed in the "How to Contact Us" section in our Privacy Statement. You will not be discriminated against for exercising any of your rights.
You may appeal decisions about your Consumer Health Data rights as follows:
- Washington. If you are a Washington resident or located in Washington and your request is denied, you may appeal our decision and we will provide the steps to appeal as part of responding to your request. Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If your appeal is denied, you may raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.
- Nevada. If you are a Nevada resident and your request is denied, you may appeal our decision and we will provide the steps to appeal as part of responding to your request. Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If your appeal is not successful, you may submit a complaint with the Nevada Attorney General at https://ag.nv.gov/Complaints/File_Complaint/.
Changes to this Notice
We may update this Consumer Health Privacy Notice from time to time. When we do update it, for your convenience, we will make the updated statement available on this page. We will always handle your Consumer Health Data in accordance with this Notice in effect at the time it was collected unless we provide you with the new notice and/or obtain your consent or authorization, as appropriate.
